Fulfilling its promise to zero in on advisors who have never been examined, the Securities and Exchange Commission announced Thursday its exam sweep of such advisors through its Never-Examined Advisor Initiative.

Jane Jarcho, national associate director of the SEC’s Office of Compliance Inspections and Examinations’ exam program for advisors and investment companies, said Thursday that the initiative would be directed at never-examined advisors registered with the SEC for three or more years.


“Our examinations will focus on areas most important to protecting investors,” Jarcho said. “We will also promote compliance by engaging with these advisors through outreach efforts.”

OCIE will conduct examinations of a “significant percentage of advisors” that have not been examined since they registered with the SEC. These examinations, Jarcho said, will concentrate on the advisors’ compliance programs, filings and disclosure, marketing, portfolio management and safekeeping of client assets.

    From a technical perspective, NOAH ripped higher here right above its 50-day moving average of $11.37 with above-average volume. This move is quickly pushing shares of NOAH within range of triggering a near-term breakout trade. That trade will hit if NOAH manages to take out some near-term overhead resistance levels at $12.77 to $12.98 with high volume. At last check, NOAH hit an intraday high on Friday of $12.98 and volume was well above its three-month average action of 207,430 shares.


    Traders should now look for long-biased trades in NOAH as long as it’s trending above its 50-day at $11.37 and then once it sustains a move or close above those breakout levels with volume that hits near or above 207,430 shares. If that breakout hits soon, then NOAH will set up to re-test or possibly take out its 52-week high at $14.64. Any high-volume move above $14.64 will then push NOAH into new 52-week-high territory, which is bullish technical price action. Some possible upside targets off that move are $18 to $20.

Assisted Living Communities

Services bundled within one charge usually include three meals per day in a central dining room, daily housekeeping, laundry, medical reminders and around the cl ock availability of assistance with the activities of daily living such as dressing and bathing. Professional nursing and healthcare services are usually available at the community as requested or at regularly scheduled times. As of December 31, 2011, its business included 13,069 assisted living suites in 185 communities that it operated or managed. .


Skilled Nursing Facilities

SNFs provide nursing and healthcare services similar to those available in hospitals. A purpose built SNF includes one or two beds per room with a separate bathroom in each room and shared dining facilities. SNFs are staffed by licensed nursing professionals 24 hours per day. As of December 31, 2011, its business included 5,391 skilled nursing units in 69 communities.

Rehabilitation Hospitals

Rehabilitation hospitals, which are also known as inpatient rehabilitation facilities (IRFs), provide intensive physical therapy, occupational therapy and speec h language pathology services. Patients in IRFs receive a mi! nimum of ! three hours of rehabilitation services daily. IRFs also provides radiology, laboratory, telemetry, hemodialysis and orthotics/prosthetics services. Outpatient satellite clinics are often included as part of the services offered by IRFs. As of December 31, 2011, its two rehabilitation hospitals had 321 beds available for inpatient services and provided rehabilitation services at the two hospitals and three satellite locations. In addition, it operates 13 outpatient clinics affiliated with its rehabilitation hospitals where patients discharged from hospitals can continue their therapy programs and receive amputee, brain injury, neurorehabilitation, cardio-pulmonary, orthopedic, spinal cord injury and stroke rehabilitation services.


Institutional Pharmacies

Institutional pharmacies provide drugs at locations where patients with recurring pharmacy requirements are concentrated. The Company’s five institutional pharmacies are located in six leased comm ercial spaces and one owned commercial building containing a total of approximately 67,759 square feet plus parking areas for its employees and delivery vehicles.

    The sky didn’t fall, but it might have seemed like it this week for shareholders of Five Star Quality (NYSE: FVE  ) . The stock dropped 21% after the operator of long-term-care facilities reported quarterly earnings.

    United Community Banks (UCBI) has 106 branches in Georgia, North Carolina and Tennessee. The bank has seen continual credit improvements and a recovering economy drive 100% earnings gains this year. The bank is one of the few seeing strong loan growth, and business is so good that UCBI paid back its TARP obligations without needing to issue new equity. This cheap stock was upgraded to an “A” last July and at the current price. The P/E ratio right now is just 5.
