    OptimumBank Holdings, Inc. (NASDAQ: OPHC) gained 11.5 percent to $5.15.

Canadian plane maker Bombardier (BDRAF) scored a huge win in its ongoing trade dispute with Boeing.

The U.S. International Trade Commission voted unanimously Friday that Boeing (BA)was not harmed by Bombardier and its all-new C Series jet.

The vote effectively shelves two tariffs, totaling nearly 300%, that the U.S. Commerce Department wanted to impose on Bombardier.

Boeing, the American aerospace giant, claims Canada’s Bombardier unfairly benefited from government bailout subsidies. Boeing says those funds allowed Bombardier to sell its new C Series airliner to Delta Air Lines (DAL) at “absurdly low prices” in violation of U.S. trade rules.

Delta in 2016 ordered up to 125 of the 110-seat C Series jets. Deliveries were expected to begin in spring 2018, but those plans are in question pending the outcome of the case.

While Boeing’s claims of harm come as the Trump administration strikes an aggressive posture on trade, the ITC’s appointees were all chosen by either Presidents Barack Obama or George W. Bush.

    Market fears of an escalating Middle Eastern conflict abated thanks to last week’s military strikes against the Syrian government. On Friday, April 13, U.S. forces joined the United Kingdom and France in retaliation for a chemical gas attack carried out by the Syrian government. Trump responded to criticism by saying he is fully confident that the Korean dictatorship will follow through. A U.S. district court will rule on whether to approve an $85 billion merger between AT&T Inc. (NYSE: T) and Time Warner Inc. (NYSE: TWX). The decision comes after about six weeks of debate in a courtroom. The ruling will likely have a significant impact on the proposed bid by The Walt Disney Co. (NYSE: DIS) for media giant Twenty-First Century Fox Inc.(NYSE: FOXA). The Fed Open Market Committee kicks off its June meeting today. The U.S. central bank is expected to raise interest rates for the second time in 2018. On Wednesday, U.S. Federal Reserve Chair Jerome Powell will likely announce a hike of 0.25% to the benchmark rate to 2%. This would also mark the seventh hike since December 2015. Markets will be looking for clues during Powell’s conference to determine how many additional times the Fed plans to raise interest rates during the final six months of the year.

Keurigs plight (actually, JABs) is worsening, with the K-cup market slowing to almost no growth now, and Keurig continuing to lose own brands share. Starbucks (SBUX) echoed the notion of a K-cup market slowdown at its seminar on Wednesday (and is guiding for its [consumer packaged goods, or CPG,] growth below recent trends), but it expects to increase its share of total CPG coffee to 20% from 15%. Come early February it will be a year since the closing of the Keurig deal for JAB Holdings. The pressure on JAB is more significant if we take into account the high leverage of the deal (JAB contributed one fourth of the $12Bn price tag). It is a tough predicament. On the one hand we argue that to make that deal work, they need to buy more (own) brands either from the retail channel (that can be extended to CPG: Dunkin (DNKN)? Panera (PNRA)?), or outright buy CPG brands (like the entire Kraft Heinz portfolio, and or Tata Groups Eight OClock brand). But can/how do they fund these deals? Maybe Mars and Warren Buffett (Mars is involved in office coffee with Starbucks), private equity, and or 3G can help? While this note is not about Positive-rated Mondelez, we have mentioned before a scenario where Kraft Heinz buys Mondelez and partly funds the deal by selling its own CPG coffee business (~$3Bn we say) to JAB as well as divests the Mondelez 20% plus stakes in Keurig (North America) and Jacobs Douwe Egberts (Western Europe), which together at this stage are worth ~$7-8Bn. But, yes, JAB will need deep-pocket partners and generous lenders. Net, JAB needs to do something soon.
