TECO Energy (NYSE: TE ) reported Q1 earnings (link opens a PDF) today, missing on sales but topping analysts’ earnings estimates. First-quarter revenue clocked in at $661 million, just shy of Mr. Market’s $668 million prediction. But what the company cut off the top line, it made up for on bottom-line numbers. EPS came in at $0.19, two cents above analyst expectations. Compared with Q1 2012, sales are down 5.2% and net income dropped 18%.
“We are off to a good start for 2013, and our results this quarter position us well for the remainder of the year despite another mild winter in Florida,” said TECO President and CEO John Ramil in a statement. “The utilities are benefiting from continued improvements in the state and local economies, and TECO Coal is operating profitably even in a weak market, with a strong focus on margins and cost control.”
On a GAAP basis, regulated utility Tampa Electric continued to carry TECO, accounting for 76.6% of the company’s total $41.5 million net income. However, the biggest gains came from its Peoples Gas System subsidiary, which boosted net income 25% to reach $13.8 million because of increased retail sales and 1.3% customer growth.

Its franchise agreement requires franchisees to pay the Company a base royalty equal to 14% of the franchisee’s tax prep aration revenue, subject to certain specified minimums. Fran! chisees acquiring territories under its no franchise fee alternative will be required to pay it franchise royalties of 25% through their first five tax seasons, and thereafter 14% of their tax preparation revenue. The Company earns advertising fee revenue from its franchisees. Its franchise agreement requires all franchisees to pay the Company an advertising fee of 5% of the franchisee’s tax preparation revenue.
The Company offers two types of financial products: refund transfer products, such as electronic refund checks (ERCs), which involve providing a means by which a customer may receive his or her refund, and refund-based loans, such as refund anticipation loans (RALs) and instant cash advances (ICAs). The Company earns fees from the use of these financial products. The Company also earns tax preparation revenue directly from both the operation of company-owned offices and the provision of tax preparation services through its eSmartTax online product.

From a technical perspective, EXAM exploded higher here right off some near-term support at $21.91 with heavy upside volume. This stock has been uptrending strong for the last six months, with shares soaring higher from its low of $13.79 to its intraday high of $24.40. During that uptrend, shares of EXAM have been consistently making higher lows and higher highs, which is bullish technical price action. This move also pushed shares of EXAM into breakout territory, since the stock took out its former 52-week high at $23.56.
Traders should now look for long-biased trades in EXAM as long as it’s trending above $23 or $22.50 and then once it sustains a move or close above Wednesday’s high of $24.40 with volume that hits near or above 209,788 shares. If we get that move soon, then EXAM will set up to enter new 52-week-high territory, which is bullish technical price action. Some possible upside targets off that move are $28 to $30.

I normally don’t look at charts much, but comparing Orange to its competitors in the French telecommunications market is quite fascinating. As one can see, incumbents Bouygues (BOUYF.PK) and Vivendi (VIVHY.PK) (owner of SFR) saw similar price declines. Noodles and burritos
The real appeal of Noodles and Company seems to come from its ambitious expansion plan. In its S-1 filing, management says it believes the company’s store count can grow from 339 stores today to 2,500 in 15-20 years. There’s no question that management can continue opening stores, but the company needs to be able to maintain enough appeal to make the expansion profitable. Jack in the Box (NASDAQ: JACK ) , by comparison, has over 2,500 restaurants nationwide, including 600 Qdoba Mexican Grills, yet its market cap sits at just $1.8 billion, a similar valuation to the much smaller Noodles. Notably, Qdoba was once hailed as the successor to Chipotle, but its parent company recently announced it would close 67 underperforming locations of the burrito chain because of declining same-store sales.

Cricket is also a prepaid carrier with no contracts, and Leap absolutely pays subsidies. On the most recent conference all, CFO R. Perley McBride noted that the company has made progress reducing subsidy costs, which were down $24 million sequentially in the fourth quarter.
