Two weeks from now, the US Supreme Court will hear oral arguments in the landmark case: Christie vs. Professional & Amateur Sports Protection Act (1992) asserting that it, among other injustices, is an undue incursion of the sovereign right of states to legalize wagering on sports. The case springs from a lawsuit by New Jersey Governor Chris Christie. Although online casino play is already legal in that state, sports betting is not. Through a succession of lower court rulings that cited the federal statute, Christie has taken the fight to the nations highest court. The outcome of that ruling, to come sometime this year, could trigger a bonanza for companies already in the online wagering sector. The American Gaming Association has issued an amicus curiae brief to the court favoring legal sports betting citing its estimate that it represents $150 in annual revenue to illegal bookmakers, much of which is diverted to finance organized criminal enterprises.

Cincinnati Financial (CINF) tumbled to the bottom of the S&P 500 today after the insurer warned of larger catastrophe losses and lower reserve releases.
Cincinnati Financialdropped 6.7% to $69.91 today, while the S&P 500 declined 0.2% to 2,270.44.
Sandler O’Neil’s Paul Newsome and team explain why Cincinnati Financial got hammered today:
On January 12, 2017, before the market opened, CINF pre-announced 4Q16 catastrophe loss estimates and underwriting results. The company expects 4Q16 earnings to include pre-tax catastrophe losses of approximately $75 million to $85 million, representing an impact on the combined ratio of approximately 6.5 to 7.5 percentage points, based on estimated property casualty earned premiums…
While the press release headline led with higher catastrophe losses, the real issue was less favorable reserve development related to the companys commercial casualty line.Cincinnati Financial has been growing faster than its peers for some time. The company has been growing primarily due to geographic expansion which is better than growth through price cutting. Nevertheless, growth during a soft market is difficult and the fourth quarter profit warning will likely lead to renewed concerns thatCincinnati Financial cannot maintain its excellent profitability in its commercial insurance business.
Cincinnati Financial’s market capitalization fell to $11.5 billion today from $12.3 billion yesterday. It reported net income of $634 million on sales of $5.2 billion in 2015.

Paragon Offshore’s (OTCPK:PGNPQ) former management’s audacious efforts to omit parts of the senior secured lenders by deeming them unimpaired and instead pay out the majority of the company’s cash to junior unsecured bondholders by presenting a set of entirely unrealistic business forecasts to the court. Fortunately, in case of Paragon Offshore, the bankruptcy judge recognized the framing and accordingly denied confirmation of the company’s plan of reorganization, effectively sending Paragon Offshore back to the drawing board. Consequently, management was ousted after the failure. I have covered the Paragon Offshore saga in a series of articles over the past few quarters, so interested investors might want to take a look at this highly fascinating and still evolving case study.

With even brand new rigs struggling to find work, the jig was soon up for owners of old equipment, like Paragon Offshore (OTCPK:PGNPQ), which is currently undergoing its second debt restructuring in less than three years of independent existence. Likewise, drillers with a fondness for aggressive use of debt were soon in trouble, most notably, former high-flier Seadrill (SDRL) and its little brother North Atlantic Drilling (NADL), which will no doubt file for restructuring within months. As a consequence of the crisis, the OSD industry now has a number of participants without a large debt burden, either new entrants like Borr Drilling, or established competitors that have had debt reduced in a restructuring, such as Ocean Rig (ORIG), to be followed within this year by others, almost certainly including each of SDRL, NADL, and Pacific Drilling (PACD).
