SAC’s Mathew Martoma Bloomberg News

Former SAC Capital Advisors LP portfolio manager Mathew Martoma asked a judge to force the government to turn over evidence that he says can help him beat insider trading charges as his case goes to trial next month.

Mr. Martoma in a request filed Thursday in federal court in Manhattan said prosecutors have failed to provide him with communications between the government and lawyers for the two scientists who allegedly gave him non-public information about drug trials and who will be key government witnesses.

Mr. Martoma, 39, is scheduled to go on trial Jan. 6, weeks after a federal jury found another former SAC manager, Michael Steinberg, guilty of using illegal tips to trade stocks of technology companies. Last month, SAC agreed to plead guilty and pay a record $1.8 billion for perpetrating an insider-trading scheme stretching back to 1999.

Advisors’ Opinion:

  • [By Eric Volkman]

It didn’t take long for Dole Foods (NYSE: DOLE  ) to reverse its policy on stock repurchases. Less than three weeks after initiating a buyback program, the company has suspended it. Instead, it will plow capital into upgrading its fleet of ships, a project it anticipates will cost roughly $165 million.

  • [By Rich Duprey]

That’s why seeing Dole Foods (NYSE: DOLE  ) lurch from a stock buyback program one day to suspending it weeks later so it can buy new ships instead, rattled investors and caused its stock to drop 10% so far.

The track record of the annual list is equally as impressive. Since the inaugural edition in 2003, "top stocks" have beaten the market 7 out of 10 years (the jury is still out on the current year). That beats the performance of Warren Buffett's Berkshire Hathaway (NYSE: BRK) by one year during the same span.

Insurance companies are some of the best deals on the market right now, as many of them still trade below tangible book value. And considering that book value will rise more quickly as interest rates (and interest income) move higher in coming years, Buffett's Berkshire Hathaway (NYSE: BRK) could afford to pay up to 1.25 times book value and still garner excellent long-term returns. Here's a quick list of insurers that fit the bill:

On behalf of most of my clients in 2013, I chose to overweight tech and health care. However, I did so with areas that are traditionally less volatile. I continue to own Powershares Pharmaceuticals (PJP) and/or SPDR Select Healthcare (XLV). I’ve been a proponent of “old tech” with the attractive prices and dividends; First Trust NASDAQ Tech Dividend (TDIV) fits the bill. Additionally, I have remained faithful to iShares Small Cap Value (IJS) for small-cap exposure, rather than hop on the IWO express.

How much downside? Jonas cut his price target on Hertz to $19 from $20. With Hertz shares off 1.3% at $30.34 today, that means shares could fall an additional 37%. Shares of Avis Budget Group (CAR) have fallen 1.1% to $67.97.

The price of renting a car — often the American traveler’s transportation of choice — has risen substantially in recent times. Ponying Up in Portland An August survey by found that the average daily rate for the cheapest available rental car in many cities was much higher on a year-over-year basis. For example, the most expensive city was Portland, Oregon, with a $111 rate, while in the car manufacturing capital of the country, Detroit, it stood at $90, and in Denver it was $88. Rewinding one year, CheapCarRental’s survey had a rate of $86 for Portland, $55 for Detroit and $65 for Denver. The blame can be laid at the feet of the major rental companies. Avis Budget Group (CAR), for example, in its most recently reported quarter, lifted its U.S. rates by around 4 percent, excluding its budget brand Payless and short-term rental subsidiary Zipcar. Such raises seem to be a habit for the company these days — in the previous quarter, it advanced its U.S. pricing by 2 percent. Given that, it’s no surprise that the company’s revenue advanced 10 percent on a year-over-year basis to $2.2 billion in that most recent quarter, while net profit grew a robust 28 percent to $74 million. The other big publicly traded auto lender, Hertz Global Holdings (HTZ), saw a nearly 20 percent pop in revenue in its fiscal 2013, with top line rising to $10.8 billion. This, despite a heavy slate of recalls from the industry’s big suppliers. So far in August alone, General Motors (GM) has recalled in excess of 380,000 vehicles. Meanwhile, in the same month, Ford (F) began the recall of 83,250 of its cars across several models. Fewer Cars in the Parking Lot Behind the higher bills and fatter profits is consolidation. With fewer competitors, of course, there’s less pressure to offer attractive prices. Avis Budget Group gets half its name from the Budget chain, acquired in 2002. We believe operational issues can and will be corrected and, therefore, in combination with the highly attractive spin we maintain our Buy rating. Hertz remains in our eyes an attractive investment over the next 12-18 months, but is likely to remain volatile. We recommend buying on the dips; our 12-motnh price target remains $33. We continue to strongly recommend Avis Budget (CAR) and would use any Hertz-related weakness to buy the stock. Industry fundamentals are strong and pricing is sustainable, in our view.

Utility stocks set the pace for the broader market over the first six months of 2014, as fears of rising interest rates abated and companies produced solid first-quarter financial and operating numbers.

Second-quarter reporting season will get underway later in July, with most management teams posting results in early August.

There’s also been significant mergers-and-acquisitions rumor and activity, notably surrounding the telecom space. And Wisconsin Energy Corp (NYSE: WEC) last week announced a deal to buy UF Portfolio Holding Integrys Energy Group Inc (NYSE: TEG) for $9.1 billion in cash, stock and assumed debt.

Canadian stocks are back to their winning ways thus far in 2014, with the S&P/TSX Composite Index posting a 12.5 percent total return in US dollar terms from Dec. 31, 2013, through June 30, 2014. The S&P 500 Index is up 7.1 percent, the MSCI Wor ld Index 6.6 percent.
