Among recent enforcement actions, the Department of Labor oversaw the restoration of nearly $2 million in 401(k) benefits to the employees of Lange Trucking Inc., a contractor with the U.S. Postal Service.
In addition, the SEC charged Diamond Foods for boosting earnings growth via an accounting scheme to inflate the price of walnuts.
DOL Sees Nearly $2 Million Restored to U.S. Postal Contractors
After an investigation by the Wage and Hour Division of the Department of Labor, Lange Trucking Inc. was on the hook for nearly $2 million in unpaid 401(k) contributions for its employees.
Lange, which had a contract with the U.S. Postal Service that employed 515 drivers, had failed to make the contributions — and had been previously investigated several times by Wage and Hour. It was acquired, subsequent to its violations, by Eagan, Minn.-based Hoovestal Inc., which voluntarily agreed to provide the bulk of the missing benefit contributions — $1.48 million — while Lange itself agreed to provide $500,000.

In this series, I examine inventory using a simple rule of thumb: Inventory increases ought to roughly parallel revenue increases. If inventory bloats more quickly than sales grow, this might be a sign that expected sales haven’t materialized. Is the current inventory situation at Encore Wire (Nasdaq: WIRE ) out of line? To figure that out, start by comparing the company’s inventory growth to sales growth. How is Encore Wire doing by this quick checkup? At first glance, not so great. Trailing-12-month revenue decreased 9.2%, and inventory increased 0.3%. Comparing the latest quarter to the prior-year quarter, the story looks decent. Revenue grew 3.9%, and inventory expanded 0.3%. Over the sequential quarterly period, the trend looks healthy. Revenue dropped 4.1%, and inventory dropped 5.1%.

Encore Wire (NASDAQ: WIRE ) , like a strip of its namesake product, seems to believe in keeping its shareholder payouts long and straight. The company has declared a quarterly dividend of $0.02 per share, to be paid on July 19 to shareholders of record as of July 5. That amount is in line with every one of the firm’s previous distributions stretching back to early 2007.

After a banner 2013, the overall market has had a challenging start to 2014. However, these four companies have been crushing it: Alexander Real Estate (NYSE: ARE ) , BioMed Realty Trust (NYSE: BMR ) , CommonWealth REIT (NYSE: CWH ) , and Sun Communities (NYSE: SUI ) early on in 2014 vs. the S&P 500. Their relative out-performance can also be seen when compared to the Vanguard REIT Index ETF (NYSEMKT: VNQ ) a good yardstick to measure sector performance.
- [By Howard Gold]
In May, I said real estate investment trusts (REITs) “have outperformed the S&P 500 for 11 of the last 16 quarters” and so “I’d be inclined to take at least some profits.” That column ran pretty close to REITs’ all-time high and the Vanguard REIT Index ETF (VNQ) has lost 11% of its value.

Fair Value: In calculating fair value, I consider the NPV MMA Differential Fair Value along with these four calculations of fair value, see page 2 of the linked PDF for a detailed description:
1. Avg. High Yield Price
2. 20-Year DCF Price
3. Avg. P/E Price
4. Graham Number
SYY is trading at a premium to all four valuations above. The stock is trading at a 37.5% premium to its calculated fair value of $26.26. SYY did not earn any Stars in this section.
Dividend Analytical Data: In this section there are three possible Stars and three key metrics, see page 2 of the linked PDF for a detailed description:
1. Free Cash Flow Payout
2. Debt To Total Capital
3. Key Metrics
4. Dividend Growth Rate
5. Years of Div. Growth
6. Rolling 4-yr Div. > 15%
SYY earned two Stars in this section for 2.) and 3.) above. The stock earned a Star as a result of its most recent Debt to Total Capital being less than 45%. SYY earned a Star for having an acceptable score in at least two of the four Key Metrics measured. The company has paid a cash dividend to shareholders every year since 1970 and has increased its dividend payments for 43 consecutive years.
Dividend Income vs. MMA: Why would you assume the equity risk and invest in a dividend stock if you could earn a better return in a much less risky money market account (MMA) or Treasury bond? This section compares the earning ability of this stock with a high yield MMA. Two items are considered in this section, see page 2 of the linked PDF for a detailed description:
1. NPV MMA Diff.
2. Years to > MMA
The NPV MMA Diff. of the $282 is below the $500 target I look for in a stock that has increased dividends as long as SYY has. If SYY grows its dividend at 3.6% per year, it will take 3 years to equal a MMA yielding an estimated 20-year average rate of 3.41%. There is a lesson in Middleby (MIDD). The company came out on February 25 and announced a tiny little beat. They beat by 37 cents a share over analyst’s expectations. That drove the stock up about 13% and you are now looking at shares that are trading around $300. Now the lesson here is, “Well, what do you do when you have had a stock that has moved up as much as this, that is trading at this price, and how do you decide whether you are going to sell or not?” Typically, you look at price trends You look at fundamentals and all those things are favorable for Middleby and one of the things that people tried not to do here is to sell just simply because they are nervous at their own success. The stock is up about 107% since I added it to the Long-Term Jubak Picks 50 Portfolio in May, since 107% less than a year. At $300, it is starting to feel expensive to many people. I think the inclination that people have is to sell.
