AP The criminal investigation that opened Wednesday into General Motors’ handling of an ignition flaw linked to 13 deaths adds to legal challenges that threaten to overshadow the company’s turnaround. GM (GM), the largest U.S. automaker, is now at the beginning of a potentially years-long road dotted with inquiries, lawsuits, government fines and public skepticism. Besides the U.S. Justice Department probe, GM must answer to Congress, the Transportation Department and lawyers the company hired to investigate itself. Toyota Motor (TM) is still being examined over recalls in 2009-10 related to reports of unintended acceleration in some cars. GM similarly faces repercussions for waiting to recall 1.6 million vehicles last month, even though records show it was aware as far back as 2004 of ignition switches that could slip out of position, cutting off power and deactivating air bags. The crisis arrives weeks after Mary Barra took over as chief executive officer amid rising investor and consumer optimism as GM shook off the last vestiges of its 2009 bankruptcy. “Barra is getting her feet thrown right into the fire,” Dave Sullivan, an industry analyst with Southfield, Mich.-based AutoPacific, said in an interview. “There’s no way she is going to come out of this looking like some kind of hero. The best thing is to be honest and upfront and hopefully put this to bed as quickly as possible.” A spokesman for Detroit-based GM, Greg Martin, declined to comment. Martin said March 10 the company was cooperating with regulators and lawmakers and that it welcomed the opportunity to help “parties have a full understanding of the facts.” Consumer Lawsuits GM tumbled 5.1 percent to $35.18 Wednesday, its worst one-day share drop at the close since March 2012. Ok, when indexes break (change) their rules they start setting investors up for serious disappointment and confusion down the road. S&P Dow Jones Indices has announced a revised treatment of Google Inc. (NASDAQ: GOOG) for its Class A and Class C shares in the S&P 500 and S&P 100, as well as related changes to methodology for the similar index. While this may take until late 2015 to occur, this is a handy change that could come with many ramifications ahead for index investors.

Steinway Musical Instruments (NYSE: LVB ) has ceased to be the owner of its iconic Steinway Hall in New York City. The company formally closed a deal to sell the building to a partnership headed by real estate concern JDS Development Group. Steinway received $46.3 million in the acquisition, and will recognize a taxable gain of roughly $22 million.

The year ahead should be a great one for the smaller bank stocks. Larger regionals like Huntington Bancorp (HBAN) and Capital Ban Financial (CBF) have made it clear they intend to grow by acquisition in the years ahead. Banks like First Merit (FMER) and First Merchants (FRME) have done deals in the past year and are open to doing more to increase their market share and footprints. This should be the year the floodgates open and we see the first wave of merger activity in small banks.

However, that growth is 20% in FY13, 15% in FY14 and 9% in the long term. PAG stock trades at $41, or about 13x FY14 estimates. It has the least leverage of all, at about $1 billion, and while it has positive FCF, that figure is weaker than our other options. PAG isn’t the worst of the car stocks, but AN stock is in better condition. I’ll pass on PAG.

In a recent interview right here on GuruFocus, Tom Gayner of Markel (MKL) had a few things to say about CarMax (KMX). This prompted me to give the company a closer look. What follows is a business analysis. We will save considerations of stock analysis, such as price, for a later discussion.
I think that is a business that will continue to grow. I don’t see any reason why you can’t have a Carmax in a lot of towns way beyond what they’re talking about right now. I think being the number one dealer, and having the number one market share in used car arena gives you great information on what transaction prices are. Then you work on the process to be as quick and as cost efficient in fixing the car and getting it sold, and have the confidence from customers when you offer warranties on the products. Those factors create a virtuous cycle. The more you do, the more you can do, the better the pricing is, the more the customers like you, the more your brand matters. The co mpany will be around for a good long time. The management has done a very good job of creating the system and executing it.
CarMax was formed as a unit of Circuit City in 1993 and was spun off in 2002. Used-car sales account for about 80% of revenue. Competitors include, but certainly are not limited to, AutoNation (AN) and America’s Car-Mart (CRMT) as well as private party sellers.
