Furthermore, the court’s finding does not undermine the use of the ATS in cases of human rights abuses. It just requires a stronger connection to the United States. That means that other ATS cases currently working their way through the legal system, such as Earth Rights International’s case against Chiquita (NYSE: CQB  ) for allegedly funding and arming Colombian terrorists, are still on track. That also means that the link from human rights violations to corporate liability remains.

Charlotte, N.C.-based Chiquita Brands (NYSE: CQB  ) will soon have a new chief financial officer — and a new chief operating officer, too. Sort of.

After all, like Chiquita Brands (NYSE: CQB  ) , Dole’s been undergoing a significant corporate restructuring, and last month it sold its packaged-foods and Asia fresh business for $1.7 billion, making it a more focused international fresh fruit business, but one subject to all the vagaries that entails. In comparison, Chiquita’s reorganization has it looking to become a high-volume, low-cost producer of bananas and chopped salads.

Treasurer Joe Hockey said Yanzhou Coal Mining Co. (YZC) no longer needed to meet a Dec. 31 deadline for reducing its stake in Yancoal Australia Ltd. (YAL.AU) below 70%, citing the downturn in global coal prices. Yanzhou, which owns 78% of Yancoal Australia, had made the commitment in 2009 to complete its 3.5 billion Australian dollar (US$3.2 billion) takeover of Felix Resources Ltd.

Yanzhou Coal Mining Co. (YZC), China’s fourth-largest coal producer, lost 3.6 percent last week to $10.33. The company posted its eighth weekly slump, the longest stretch of declines since August 1998. Bank of America Corp. cut the stock to the equivalent of sell from neutral May 3.

Yanzhou Coal Mining (YZC) engages in the underground coal mining, as well as preparation, processing, sale and railway transportation of coal. This stock closed up 7.6% to $7.31 in Thursday’s trading session.

    Thursday’s Range: $7.14-$7.31

    52-Week Range: $6.68-$18.57

    Thursday’s Volume: 391,000

    Three-Month Average Volume: 370,383

From a technical perspective, YZC bounced sharply higher here right off some near-term support at $6.77 with above-average volume. This stock has been downtrending badly for the last six months, with shares plunging from its high of over $14 to its recent low of $6.68. During that move, shares of YZC have been consistently making lower highs and lower lows, which is bearish technical price action. That said, shares of YZC have recently formed a double bottom chart pattern at $6.68 to $6.77. This stock now looks ready to reverse that downtrend and possibly trigger a near-term breakout trade. That trade will hit if YZC manages to take out some near-term overhead resistance levels at $7.76 to $8 with high volume.

Traders should now look for long-biased trades in YZC as long as it’s trending above its recent low of $6.77 and then once it sustains a move or close above those breakout levels with volume that hits near or above 370,383 shares. If that breakout triggers soon, then YZC will set up to re-test or possibly take out its next major overhead resistance levels at $9 to $10. Any high-volume move above those levels will then give YZC a chance to tag its next major overhead resistance levels at $10.67 to $11.11

Advisors’ Opinion:

  • [By John Udovich]

Small cap patent stocks Spherix Inc (NASDAQ: SPEX), PDL BioPharma Inc (NASDAQ: PDLI) and Endeavor IP Inc (OTCBB: ENIP) are among the growing number of publicly traded US entities focused on collecting and making money from various types of patents. After all, monetizing patents can lead to incredible returns. For example: Nomura analyst Rick Sherlund wrote in a research note back in November that Microsoft Corporation (NASDAQ: MSFT) is generating $2 billion per year in revenue from Android patent royalties and he estimates that this revenue has a 95% margin. However, there are risks associated with investing in stocks that invest in patents because a bi-partisan bill called the Innovation Act (H.R. 3309) is working its way through Congress to try and reign in the activities of so-called “patent trolls” or rather companies that buy or license patents from others.

In more than two decades as a publicly-traded company, Spherix Inc. (SPEX) developed diabetes treatments, marketed a low-calorie sweetener and handled campground reservations. Now it’s dealing in something completely different: patents.

The Company’s wholly owned subsidiary, Seadrill Operating GP LLC, the general partner of Seadrill Operating LP, will manage Seadrill Operating LP’s operations and activities. The Company is also an international offshore drilling contractor.

Advisors’ Opinion:

  • [By Aaron Levitt]

The key to SDRL has been its relationship with its master limited partnership subsidiary SeaDrill Partners (SDLP). SeaDrill has been quite successful at “dropping down” assets into SDLP to avoid taxes and gain hefty distributions. All of which continues to boost cash flows and dividend yields for SDRL stock.

  • [By P.I.A.]

The Norwegian driller has several investments in other companies. It holds roughly 12% of SapuraKencana Petroleum Bhp pursuant to sale of the tender rig business. There is also a Seadrill Partners LP (SDLP), after its October 2012 IPO, and its drilling units have been valued at a premium to Seadrill’s own rigs. Seadrill owns 75% of SDLP and also 73% of North American Drilling.

10 Best Performing Stocks To Invest In Right Now: Ishares Msci Korea (EWY)

iShares MSCI South Korea Index Fund (the Fund) seeks to provide investment results that correspond generally to the price and yield performance of publicly traded securities in the aggregate in the South Korean market. The Fund’s performance is measured by the MSCI Korea Index (the Index).

The Fund invests in a representative sample of securities in the Index, which has a similar investment profile as the Index. iShares MSCI South Korea Index Fund’s investment advisor is Barclays Global Fund Advisors.

Advisors’ Opinion:

  • [By Benjamin Shepherd]

The iShares MSCI Emerging Markets Index (NYSE: EEM) seems to have halted its slide.  The index bottomed out year-to-date on February 3, when it was down 11.2 percent. Since then, it has gained 1.5 percent, but bargains in the emerging markets still abound.

As I discussed in “A Plan, Not a Panic” two weeks ago, emerging markets are in much better economic shape today than they were even just a few years ago, much less during the currency crisis that peaked in 1998. Foreign exchange reserves are generally much more robust, budget deficits are narrower if they exist at all and, so far at least, the full-blown currency war that many were predicting last year isn’t likely to breakout.

With rationality finally setting in, this is a terrific time to do a little bargain hunting in the emerging markets.

The most obvious play here is the iShares MSCI Emerging Markets Index itself. Covering China (18.8 percent of assets), South Korea (16 percent), Taiwan ( 12 percent) and Brazil (10.2 percent) with smaller positions spanning Asia and Europe, the fund is most exposed to any shift in sentiment.

The fund is currently trading at just 10.2 times forward one-year earnings, well below its average of about 18 times over the past two decades. On a price-to-sales basis it is even more attractive valued at just 1.03 times; the last time the index was this cheap on a sales basis was early 2009.

So while there are always dangers in trying to call a bottom to any market move, valuations alone are attractive enough to start pulling bargain hunters back in.

A broadly diversified play on an emerging market turnaround, iShares MSCI Emerging Markets Index is a great buy up to 45, which leaves plenty of room to run back to the average.

For those who can tolerate a bit more risk, you can also drill down and make more country-specific bets.

At this point my favorite would be iShares MSCI South Korea Index Fund (NY SE: EWY).

10 Best Performing Stocks To Invest In Right Now: Nanosphere Inc.(NSPH)

Nanosphere, Inc. develops, manufactures, and markets molecular diagnostics platform, the Verigene System that enables genomic and protein testing on a single platform. Its Verigene System includes a bench-top molecular diagnostics workstation with nanoparticle technology that provides the ability to run multiple tests simultaneously on the same sample. The Verigene System is used for testing infectious disease assays, human and pharmacogenetic assays, and ultra-sensitive protein assays. The company serves hospital-based laboratories and academic research institutions in the United States. Nanosphere, Inc. was founded in 1998 and is headquartered in Northbrook, Illinois.

Advisors’ Opinion:

  • [By Roberto Pedone]

One under-$10 medical equipment player that’s quickly moving within range of triggering a major breakout trade is Nanosphere (NSPH), which develops, manufactures and markets an advanced molecular diagnostics platform, the Verigene System, which enables simple, low-cost and highly sensitive genomic and protein testing on a single platform. This stock has been hit hard by the bears so far in 2013, with shares off by 27%.

If you take a look at the chart for Nanosphere, you’ll notice that this stock is just starting to spike sharply higher today back above its 50-day moving average of $2 a share. This spike is quickly pushing shares of NSPH within range of triggering a major breakout trade. That breakout will trigger once NSPH manages to take out the upper-end of its recent sideways trading chart pattern.

Traders should now look for long-biased trades in NSPH if it manages to break out above some near-term overhead resistance levels at $2.17 to $2.20 a share and then once it takes out its gap down day high from August at $2.29 a share with high volume. Look for a sustained move or close above those levels with volume that hits near or above its three-month average action of 652,718 shares. If that breakout hits soon, then NSPH will set up to re-fill some of its previous gap down zone from August that stated just above $3 a share. If that gap gets filled with volume, then NSPH could easily tag $3.50 to $4 a share.

Traders can look to buy NSPH off any weakness to anticipate that breakout and simply use a stop that sits right below some key near-term support levels at $1.81 to $1.77 a share. One can also buy NSPH off strength once it clears those resistance levels with volume and then simply use a stop that sits a comfortable percentage from your entry point.

  • [By Jon C. Ogg]

Nanosphere Inc. (NASDAQ: NSPH) is not exactly a household name in molecular diagnostics, and apparently it needs better name recognition for boosting sales. Its sales were disappointing and the stock was down almost 18% at $2.40, and now we have indications down around $2.35 in Wednesday trading indications.

If you’re reading this, then odds are you already know that small caps WidePoint Corporation (NYSEMKT:WYY), CytRx Corporation (NASDAQ:CYTR), and Elephant Talk Communications Corp. (NYSEMKT:ETAK) are among the recent big winners from the small cap stock realm. ETAK is up 100% since the end of October, largely spurred by encouraging numbers in its third-quarter results. CYTR shares have rallied more than 150% in just the past three days on the heels of an announcement that a cancer drug the biotech company is developing has shown wonderful Phase 2 results. And, WYY has advanced 93% over the past month or so, thanks to Q3’s earnings announcement, though the trading public – and then the media – certainly took the ball and ran with it.
